Customs Notice 10-015: United States Loaded Freight Remaining On Board (FROB) Cargo

(CBSA)

1. Pursuant to Customs Notice 10-007, the purpose of this customs notice is to notify industry that the Canada Border Service Agency (CBSA) has reached a final resolution with regard to the grace period for Advance Commercial Information (ACI) transmission requirements for US-loaded FROB cargo. Based on a thorough analytical review of all information acquired, the following determinations are issued:

(a) The exemption for ACI notification of US-loaded FROB cargo is extended until December 31, 2010.

(b) Effective January 1, 2011, the CBSA will require ACI transmissions for US-loaded FROB cargo as per CBSA current policy.

2. Until the implementation date, marine carriers are encouraged to transit US-loaded FROB cargo information to the CBSA in order to achieve full compliance upon the full implementation date.

3. During the interim period, the CBSA will be in a position to provide guidance and assist its clients in meeting the ACI obligations related to US-loaded FROB set forth by this customs notice.

Customs Notice 10-014 - New Highway Sufferance Warehouse (Halifax, N.S.)

1. The purpose of this notice is to advise that effective June 25, 2010, the Canada Border Services Agency (CBSA) licensed Mathers Freight Management as the new Highway Sufferance Warehouse operation for the Halifax, N.S. port.

2. Mathers Freight Management is located at 165 Burbridge Avenue, Burnside Industrial Park, Dartmouth, N.S.

3. All bonded highway carriers transporting in-bond commercial freight destined for clearance at the Halifax, N.S. port should report to this highway sufferance warehouse.

CN 10-102: Highway Sufferance Warehouse Closure (Owen Sound, ON)

The purpose of this notice is to advise that Echo Transportation Services Limited, located at 248, 9th Avenue East, Owen Sound, ON, surrendered their highway sufferance warehouse licence effective May 24, 2010. The Canada Border Services Agency (CBSA) has decided not to advertise for a new highway sufferance warehouse at this port.

Therefore, all bonded highway carriers transporting in-bond commercial freight destined for clearance at this port should report to an alternate highway sufferance warehouse.

CN 10-009 – Elimination of Itinerant Carrier Codes

(CBSA)

The purpose of this customs notice is to advise that effective April 1, 2011, the Canada Border Services Agency (CBSA) will no longer accept generic itinerant carrier codes for any mode of transportation. With the implementation of eManifest (advance commercial information) in the highway mode in September 2010, the CBSA will begin phasing in new policies and procedures. Carrier codes will become a regulatory requirement for all carriers, thereby harmonizing carrier identification with the eManifest initiative.

The generic itinerant highway carrier code “77YY” will no longer be accepted for commercial cross-border activity. A unique carrier code, assigned by the CBSA, will become a part of the setup process for eManifest. To allow carriers and drivers currently using code “77YY” to obtain a carrier code, a transition period will begin on May 1, 2010, until the final elimination of code “77YY” on March 31, 2011. CN 10-010 – Elimination of the Maximum Rates of Customs Duty on Certain Woollen Fabrics

(CBSA)

1. This notice announces the elimination of the maximum rates of customs duty on certain woollen fabrics in the Customs Tariff as of March 5, 2010.

2. Article 769 of Bill C-9, amends the Customs Tariff and states:Section XI in the List of Tariff Provisions set out in the schedule to the Act is amended by deleting Supplementary Note 1 and renumbering Supplementary Note 2 as Supplementary Note 1.

3. Supplementary Note 1 dealt with the maximum rate of customs duty under the Most-Favoured Nation Tariff and eligible Commonwealth countries on woollen fabrics of tariff item Nos. 5111.11.90, 5111.20.91, 5111.30.18, 5111.30.91, 5111.90.91, 5112.11.90, 5112.19.94, 5112.20.91. 5112.30.91, 5112.90.91 and 5803.00.29.

4. Bill C-9 is an Act to implement certain provisions of the budget tabled in Parliament on March 4, 2010 and other measures.

Customs Notice CN09-021: Highway Sufferance Warehouse Closure, Cranbrook, BC

1. The purpose of this notice is to advise that, effective September 4, 2009, Mohawk Terminals Ltd., located at 246 Slater Road, Cranbrook, BC will be surrendering their highway sufferance warehouse licence.

The Canada Border Services Agency (CBSA) has decided not to advertise for a new highway sufferance warehouse at this port.

2. Therefore, as of September 5, 2009, all bonded highway carriers transporting in-bond commercial freight destined for clearance at the Cranbrook port should report to an alternate highway sufferance warehouse.

Customs Notice CN09-019 Inclusion of Intermediary Locations for Release of Customs Self Assessment (CSA) Shipments

1. Effective immediately, CSA importers can include intermediary locations, as listed on the CSA carriers’ bill of lading, as part of their trade chain partner (TCP) list for delivery of CSA shipments as a consignee. The goods would be consigned to an intermediary location for storage and/or re-distribution to customers in Canada. Release will occur at these locations and the release date will be on the date that the goods were received at the intermediary location

2. During Part II of the importer application process, importers must submit an initial list of their trade chain partners, and are obligated to ensure that the TCP list remain current, and additions and deletions must be provided to CBSA, as per paragraphs 65 and 66 of D Memorandum D17-1-7.

3. The importer is obligated to demonstrate that their system can track and account for goods that are consigned to an intermediary location and determine the release date as the date in which the goods arrived at the intermediary location, prior to adding the intermediary location to their TCP list. The liability will be transferred from the carrier to the importer when proof of delivery (POD) is received from the intermediary location as long as it is listed on the CSA importers TCP.

4. The CSA clearance process will remain as it is today:
a. Importer is CSA approved;
b. Carrier is CSA approved;
c. In highway mode, the driver is registered as outlined in the Presentation of Persons (2003) Regulations; and
d. The goods are eligible.

Please note that the D memos are currently being updated to reflect this change and should be completed shortly.

CN09-006: Form E29B, Temporary Admission Permit – Form Requirements

1. This Customs Notice is to announce that, beginning January 1, 2010, the Canada Border Services Agency (CBSA) will no longer accept the Temporary Admission Permit, Form E29B when printed on forms which consist of coloured sheets separated by carbon paper.

2. The Form E29B (PDF, 507KB) must still be submitted to the CBSA in hard copy. If the form is completed by hand, it must be submitted on legal size paper. If the form is completed electronically, it may be submitted on letter sized paper.

3. Additional information on how to complete this form is available in Memorandum D8-1-4, Form E29B, Temporary Importations Permit.
